Configuration Placeholder
[CONFIGURATION REQUIRED BEFORE PUBLICATION: Confirm Shopify customer privacy settings, consent banner behavior, deployed cookies/pixels/SDKs, analytics tools, advertising tools, and whether disclosures to analytics or advertising partners may constitute “sale,” “sharing,” or “targeted advertising” under applicable U.S. state laws. Update this Privacy Policy, the “Your Privacy Choices” flow, and any consent banner language to match the final production configuration.]
How Long We Retain Personal Information
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:
• provide requested products and services;
• maintain accounts and subscription records;
• process payments, refunds, and recurring billing;
• satisfy tax, accounting, legal, and regulatory obligations;
• preserve records of consent, opt-outs, suppression, and privacy requests;
• investigate disputes, complaints, fraud, or security incidents; and
• enforce agreements or defend legal claims.
Retention periods may vary depending on the type of information, the nature of the relationship, legal requirements, operational needs, and risk considerations. When personal information is no longer reasonably necessary, we will delete, deidentify, or otherwise dispose of it in accordance with our retention practices and applicable law.
How We Protect Personal Information
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse. These measures may include secure hosting environments, access controls, encryption in transit, security monitoring, role-based permissions, and vendor-management practices.
[BUSINESS DECISION — SECURITY REPRESENTATIONS: Choose one approach and delete the other. Specific security promises are more reassuring to customers but create greater CSPA/deception exposure if operational reality does not match.]
Option A (General/hedged — recommended, currently reflected above): Retain the preceding paragraph describing “reasonable administrative, technical, and physical safeguards” without committing to specific technologies.
Option B (Specific — mirrors the prior policy): “We offer the use of a secure server. Sensitive information you supply is transmitted via encryption (such as Transport Layer Security) and, after a transaction, we do not store full payment-card numbers, financial account numbers, or Social Security numbers on our
servers.” Use Option B only if each specific representation is independently verified as accurate for the live environment.
No method of internet transmission or electronic storage is completely secure. Accordingly, we cannot guarantee absolute security.
How We Disclose Personal Information
We may disclose personal information to the following categories of recipients, as reasonably necessary for the purposes described above.
Shopify and Commerce Platform Providers
We disclose personal information to Shopify and related commerce platform providers to host our store, process checkout, support customer accounts, administer commerce functionality, provide fraud-prevention tools, and support analytics, reporting, and related platform services.
Subscription Providers
We disclose personal information to Loop and related subscription-management providers to administer subscriptions, recurring orders, billing schedules, skips, pauses, cancellations, customer preferences, and related subscription communications.
Payment Processors and Gateways
We disclose payment and transaction information to payment processors, gateways, and fraud-prevention partners to process purchases, recurring billing, refunds, payment retries, and payment-related risk review.
Fulfillment Providers and Carriers
We disclose personal information to warehouses, pack-and-ship vendors, logistics providers, and carriers to fulfill orders, manage returns, track shipments, and deliver products.
Hosting, Cloud, Security, and IT Providers
We disclose personal information to infrastructure providers, cloud storage providers, website hosting providers, cybersecurity vendors, authentication providers, and technical support providers.
Customer-Support Providers
We disclose personal information to customer-support software providers, call-center tools, chat providers, ticketing systems, and similar vendors that help us communicate with and support customers.
Email and SMS Providers
We disclose personal information to service providers that send transactional or marketing communications on our behalf, maintain contact preferences, process unsubscribe requests, and manage suppression lists.
Analytics, Advertising, Attribution, and Social-Media Partners
We may disclose identifiers, internet activity, commercial information, and similar data to analytics providers, advertising networks, attribution providers, and social-media platforms to measure traffic, understand campaign performance, support audience development, and, where permitted, facilitate interest-based advertising or social-media integrations.
[BUSINESS DECISION — SALE / SHARING / TARGETED ADVERTISING POSTURE: The prior policy stated that personal information would not be sold or shared for others’ marketing without consent. This draft instead contemplates disclosures to advertising, analytics, attribution, and social-media partners that may constitute a “sale,” “share,” or “targeted advertising” under various state laws. Choose one approach and delete the other; the choice must match the final Shopify/Loop/pixel/ad-tech configuration and the “Your Privacy Choices” flow.]
Option A (No sale/share — mirrors the prior policy): “We do not sell your personal information, share it for cross-context behavioral advertising, or process it for targeted advertising as those terms are defined by applicable law. We disclose personal information only to service providers acting on our behalf under contractual confidentiality obligations.” Select Option A only if pixels/cookies/ad-tech are configured so that no disclosure qualifies as a sale, share, or targeted advertising.
Option B (Sale/share may occur — supports interest-based advertising, currently reflected above): Retain the preceding advertising-partner disclosure and ensure the “Your Privacy Choices” opt-out mechanism, opt-out preference signal handling, and state-rights disclosures are fully implemented to support opt-out of sale, sharing, and targeted advertising.
Professional Advisers and Corporate Counterparties
We may disclose personal information to auditors, insurers, consultants, legal counsel, accountants, lenders, investors, and other professional advisers as reasonably necessary.
Authorities and Legal Process
We may disclose personal information to courts, regulators, law enforcement, government agencies, or other third parties where we believe disclosure is reasonably necessary to comply with law, respond to legal process, protect rights or safety, investigate wrongdoing, or enforce our agreements.
Transaction Parties
We may disclose personal information in connection with a proposed or completed merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar corporate transaction, subject to customary confidentiality and legal protections.
Business Transfers
If Vitality Now is involved in a merger, acquisition, financing, asset sale, reorganization, insolvency proceeding, or similar transaction, personal information may be disclosed, transferred, or assigned as part of the evaluation or completion of that transaction, subject to applicable law.
Operational Emails and Text Messages
We may send non-marketing emails or text messages necessary to provide requested services or administer your relationship with us. These communications may include:

• subscription confirmations, renewal reminders, skips, pauses, and cancellation notices;
• product recall or safety notices; and
• customer-service responses.
These operational communications are separate from promotional marketing. Even if you opt out of marketing, you may still receive transactional or service-related messages as needed to complete orders, maintain your account, or administer subscriptions.

If you sign up for marketing emails, or if we otherwise send commercial emails as permitted by law, those emails may include promotions, product updates, newsletters, special offers, and related marketing content.
You may unsubscribe from promotional emails at any time by:
• clicking the unsubscribe link in the email; or
• contacting us using the information in the Contact Us section below.
We will honor applicable unsubscribe requests within the time required by law. Opting out of promotional email will not prevent us from sending operational or transactional emails.
Marketing Text Messages
Where required by law, we obtain separate affirmative consent before sending marketing text messages.
By opting in to marketing texts, you agree that Vitality Now and its service providers may send recurring automated promotional and personalized marketing text messages to the mobile number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help.
You may also revoke consent through any other reasonable method that clearly communicates your request. We will honor reasonable revocation requests and maintain suppression records as required by law.
SMS Program Terms
• Marketing text consent is separate from acceptance of our Terms or completion of a purchase.
• We may retain records of opt-in, opt-out, revocation, and suppression for compliance and operational purposes.
• Carriers are not liable for delayed or undelivered messages.
• We do not disclose text-messaging originator opt-in data or consent to third parties for their own marketing or promotional purposes.
• Operational texts about orders, accounts, payments, or subscriptions are separate from marketing texts.
• Where required by law, marketing texts are sent only after obtaining the level of consent required under applicable law, including the Telephone Consumer Protection Act and similar state laws.

Our services are directed to a general audience and are not intended for children under 13 years of age. We do not knowingly collect personal information online from children under 13. We may disclose identifiers, internet activity, commercial information, and similar data to analytics providers, advertising networks, attribution providers, and social-media platforms to measure traffic, understand campaign performance, support audience development, and, where permitted, facilitate interest-based advertising or social-media integrations.

Commercial Email Marketing
